1. Relationship

Who you are buying from. You are purchasing food and related services directly from the restaurant identified on the ordering page or in the ordering messages (the "Restaurant"). The Restaurant is solely responsible for menu accuracy, food safety, preparation, fulfillment, delivery/pickup, taxes, fees it charges, and customer service relating to the food.

What OrderJam does. Lexical Systems LLC ("OrderJam") provides technology that helps you place an order via web or SMS and helps transmit order information to the Restaurant.

Automated messaging on behalf of restaurants. Messages you receive during ordering are automated and sent on behalf of the Restaurant. OrderJam provides the technology used to transmit these messages but does not sell food, set prices, or accept orders.

Dedicated restaurant numbers. The phone number you text is dedicated to the Restaurant you selected. OrderJam does not assign shared consumer numbers across restaurants.

2. Automated / AI-Assisted Ordering

OrderJam may use automated or AI-assisted features to help interpret messages and build a cart. Such systems are probabilistic and may misunderstand items, quantities, modifiers, or special instructions.

3. Accounts & Authentication

To provide order history, reordering, and saved payment options, an account may be created and linked to your phone number and/or email. Authentication may occur via one-time links or codes delivered to your phone or email. Anyone with access to your device or those links/codes may be able to access your account.

4. Payments, Refunds, and Chargebacks

Payments. Payments are processed through payment providers (e.g., Stripe). You authorize the Restaurant (through its payment provider) to charge your selected payment method for the total shown at checkout, including taxes, tips, and applicable fees.

OrderJam does not authorize charges. OrderJam never approves charges. Charges are authorized by you and processed by the Restaurant's payment provider.

Refunds/cancellations. Because the Restaurant fulfills the order, all refund and cancellation requests must be directed to the Restaurant, subject to its policies and whether preparation has started.

5. Prohibited Items (Alcohol)

The sale of alcohol is strictly prohibited on the OrderJam platform. If you see an alcohol item listed on a menu, do not purchase it. We reserve the right to cancel any order containing restricted items and suspend the offending Restaurant's account.

6. Promotions

Checkout-only promotions. Some Restaurants may offer a first-time ordering promotion that is shown during checkout and may be automatically applied if you are eligible. OrderJam does not send promotional texts inviting you back to claim the discount.

7. SMS/Mobile Messaging Program

If you text a Restaurant's ordering number or provide your phone number at checkout, you may receive automated messages from the Restaurant via the OrderJam platform.

Consent to receive promotional texts is not a condition of purchase.

8. Limitation of Liability

To the maximum extent permitted by law, OrderJam is not liable for injuries, illness, or damages arising from the food or services provided by the Restaurant. OrderJam's responsibility is limited to providing the technology service and transmitting order data.

We may update these terms by posting an updated version on this page and updating the "Last Updated" date.
